SSAM Annual Conference
SSAM is excited to announce this year’s annual conference is sure to be crowd pleaser! You don’t want to miss it! Meet us at Greektown Casino in Detroit on October 27-28, 2015. For the first time ever the conference will be a day and a half event including a U-Haul facility tour and cocktail reception at Greektown on the evening of October 27th. Know the laws!

Michigan first enacted a lien law for self storage in 1985. However, it was substantially amended and procedures simplified in 2001, 2009, and most recently in March of 2014. Any statute that affects your business is worth a very close read; a lien statute which you plan to utilize to sell a customer's stored property to collect a debt is worthy of a very close read indeed.

Michigan's self storage law is not all that different from laws in other states, but because every difference is significant in such laws, don't assume that forms or checklists or procedures followed in other states will be safe to use in Michigan. The booklet includes the provisions of the Michigan statute, followed by observations and comments designed to help you understand and follow the law. As you go through this statute, remember the first rule of statute reading: Read it again!

The Michigan Self-Service Storage Facility Act, which can be found at Michigan Compiled Statutes 570.521 to 570.527, grants self storage operators a lien on tenant property and outlines the procedures that must be followed to foreclose on delinquent tenant property. It sets out in relatively clear language the steps a facility owner must follow to enforce his or her lien rights. If there is a problem with the law, it is that it may encourage storage operators to sell delinquent tenant property too quickly. From default to sale, a storage operator could follow all the required steps and sell a tenant's goods in less than 45 days. We do not recommend that storage operators act so rapidly. A slower pace is recommended and the storage operator should make a real effort to resolve the payment problem without sale.

The booklet is a section by section analysis of the statutory language. There have been few court decisions interpreting the language of the law, so the comments that follow are based upon general interpretations of the law.

Self-Storage Industry Facts
  • The self storage industry has been one of the fastest-growing sectors of the United States commercial real estate industry over the period of the last 35 years
  • There are now approximately 46,000 "primary" self storage facilities in the United States as of year end 2009; another 4,000 are "secondary" facilities ("primary" means that self storage is the "primary" source of business revenue – US Census Bureau)
  • There are approximately 58,000 self storage facilities worldwide as of Q4 – 2009; there are more than 3,000 in Canada and more than 1,000 in Australia.
  • Fewer than 250 new self storage facilities came on line in the U.S. during 2009; the trend in new construction is down significantly the last four years.

Survey reveals technology and websites most important to ssam members
SSAM members were surveyed on how their businesses are using technology. According to the survey, despite the challenge posed by keeping up with the rapid pace of change in technology, 78 percent of respondents think it is important to keep up with new technology.

Having a presence on the web is more important today than ever. 47% of local searchers visit a local merchant as a result of their search, and 37% will make a contact online. These stats are growing every day. The Self-Storage Association of Michigan has recently partnered with a professional web agency to bring members Internet services at a discounted rate. Member/NET services include Web site design and construction, search engine optimization, social media, maintenance, consulting, and education.
